These terms apply to every visit to zaptim.com and to each order placed here. Placing an order means you have read them and agree to them. All of them. They are written in plain sentences on purpose, and where they point to a policy page, that page carries the detail and the numbers.
One company you are dealing with
The seller is Tyleka Amaya Funy LLC, a limited liability company registered in North Carolina under EIN 99-4711386, trading as Zaptim, with its registered office at 322 Charles St, Goldsboro, NC 27530. Every contract formed on this site is with that company. No other. "We", "us" and "Zaptim" in these terms mean that company; "you" means the person placing the order or using the site.
18 and over
You must be at least 18 years old to order, and you must be ordering for a lawful purpose, with a payment method you are entitled to use, to an address in the delivery area described in the Shipping Policy. An account, if you open one, is yours to keep secure, and orders placed through it are treated as yours.
Thirty dresses today, and the door left open
At the time of writing the catalog is women's dresses, thirty styles on three rails, casual, work and evening, and these terms speak of dresses because that is what is on sale. The catalog can grow. It will. Further dress categories are the likely first addition, and other products sold on the same footing may follow. Anything listed on the site at any time is sold under these terms and the same policy pages; a policy's word "dress" then means the item you ordered. When the range changes, the About page and the policy pages are rewritten to match; nothing is added quietly.
One price per dress, and what happens when it is wrong
All prices are quoted in US dollars. Prices may move over time; the figure shown at the moment of ordering is the figure charged for that order. Shipping and sales tax appear as separate lines ahead of confirmation, and the Payment Policy describes the total. Product pages are maintained by hand. Now and then a price is entered wrong. Where a listed price is plainly a mistake, the order can be cancelled ahead of dispatch, the amount refunded, and the reason given. We are not bound to sell at a price that was a typing error, and you are not bound to buy at the corrected one.
One order, accepted at dispatch
An order confirmation email is a receipt. It is not yet our acceptance. The contract for a dress is formed when the supplier dispatches it and the dispatch email is sent. Before that point an order can be declined or cancelled, for reasons such as a size that has sold out, a pricing error, a payment that fails its fraud checks, or an address the delivery area does not cover, and in every such case any amount taken is refunded in full.
One charge, two ways to pay, 24 hours to change your mind
Payment is taken at the moment you order, by card through Stripe or through PayPal, as set out in the Payment Policy. Within 24 hours of ordering you may cancel, correct the address or switch the size by emailing contact@zaptim.com; after that the order has been passed to the supplier, and a change means a return.
9 to 16 business days
Delivery windows, costs, the delivery area, duty, tracking and the handling of late, damaged and missing parcels are set out in the Shipping Policy, which forms part of these terms. Dresses ship from China with duty paid, and the 9 to 16 business day window is an estimate that most parcels meet, not a guaranteed date.
30 days to return
Returns, refunds, faults, wrong items, items not as described and cancellations are governed by the Refund and Returns Policy, which forms part of these terms. In short: 30 days from delivery, $0 restocking, postage paid by whoever caused the return.
Every photo and word on this site
The Zaptim name, the tape-measure mark, the page layouts, the product descriptions and the photographs on this site belong to Tyleka Amaya Funy LLC or are used with the permission of the people who own them. You may look at the site and print a page for your own use. You may not copy the site, its images or its text for any commercial purpose, frame it, scrape it, or use the Zaptim name or mark without written permission.
One address for copyright complaints
If you believe a photograph or a piece of text on this site copies a work you hold copyright in, email contact@zaptim.com with "Copyright complaint" as the subject. The notice must carry: which work of yours is involved, the address of the page on our site where it appears, your name, postal address and email, your statement, made in good faith, that the use lacks authorization, a statement under penalty of perjury that the information is accurate and that you own the work or act for its owner, and your physical or electronic signature. We reply within 1 business day, and material that a complete notice identifies comes down for the duration of the review. The person who posted it may send a counter-notice with the same elements.
Two rules for reviews
Product pages carry a Reviews tab. Two rules govern it. Rule one: a review can be left only by a customer who bought the dress from us, and it is marked as a verified purchase for that reason. Rule two: no review is paid for, nothing is offered in exchange for a positive one, and no review is removed for being negative. We do remove reviews that are abusive, that contain personal information about someone else, or that are plainly about a different product. By posting a review you allow us to show it on the product page with your first name and the initial of your last name. The FTC's Consumer Reviews Rule sets that standard, and we follow it.
Six things you may not do here
Use the site to break any law. Place an order with a stolen or unauthorized payment method. Open a return for a dress that was worn, or claim a parcel was not delivered when it was. Attack, probe or overload the site or its servers. Post a review you were paid for or that is not about your own purchase. Impersonate another person or another business in any message to us. Any of these ends the right to use the site. Some get reported.
Zero warranties beyond the ones the law gives you
The site and the dresses are provided as described on their pages. No warranty is given that the site will be free of errors or interruptions, and no warranty about a dress beyond the description, the size list and the fabric line on its page, read together with the Disclaimer. Your home state's consumer law gives you certain warranties and remedies that cannot be signed away, and nothing in these terms tries to take them from you.
One order value, again
Our total liability to you for anything arising out of an order or your use of the site caps at the sum you paid for that order, dresses and shipping included. Indirect and consequential losses, the cost of another outfit for instance, or lost time or travel, fall outside our liability when a dress arrives late, damaged or not at all. The cap gives way wherever your state's law refuses it. Nowhere else.
One clause that fails, sixteen that stand
If a court finds any single clause of these terms unenforceable, that clause is cut to the narrowest form the court will allow. The remaining clauses stand. These terms, together with the policy pages they name, are the whole agreement between you and Zaptim about the site and your orders, and they replace anything said in an earlier version. Where your use of the site in breach of these terms brings a claim against us by someone else, you agree to cover the costs of that claim, to the extent the breach caused it.
North Carolina law, Wayne County courts, 30 days of talking first
North Carolina law governs these terms, without regard to its conflict-of-law rules. Before either side starts any formal proceeding, we both agree to try to settle the matter by email for 30 days, starting from the day one side writes to the other describing the problem. If that fails, the state and federal courts sitting in Wayne County, North Carolina, have jurisdiction. Each of us agrees to appear there. Nothing in this section forces you into arbitration, closes the small claims route, or removes rights your own state's consumer law gives you.
One date at the top, and where to write
A change to these terms moves the date shown under the title, and the new terms apply to orders placed after that date. Orders already placed keep the terms they were placed under. A change that matters is announced on the site.
